第１条（目的）
この利用規約（以下「本規約」といいます）は、株式会社ウェザーニューズ(以下「当社」といいます)が提供する、当社の従業員採用選考に関するホームページ「Weathernews Recruit My Page」（以下「本サイト」といいます）を会員の方が利用するに際して遵守していただく事項及び利用方法、利用条件等を定めたものです。
第２条（定義）
本規約における用語の定義は以下の通りです。
１．「会員」とは、現在就職活動中の方で、直接、または連携するサイト経由にて、本サイトより当社の従業員採用選考に応募する個人の方をいいます。
２．「個人情報」とは、会員に関する情報であって、当該情報を構成する氏名、住所、電話番号、メールアドレス、学校名、生年月日、及びその他の記述等により当該会員を識別できるもの（当該情報のみでは識別できないが、他の情報と照合することにより当該個人を識別できるものを含みます）をいいます。
第３条（規約の遵守）
１．会員は、本規約を理解し、その内容をすべて同意した上で、本サイトを利用するものとし、また、本規約を遵守しなければなりません。
２．会員が本サイトを利用した時点をもって、本規約の内容をすべて同意し、本規約を当該会員と当社との間の契約の内容とすることを合意するものとし、会員において本規約を遵守するを約するものとします。
３．本規約に規定していない本サイトの利用条件は、当社がその都度定めます。当社が別途定める利用条件、規約、遵守事項なども本規約と同一の効力があるものとし、本規約と同様に扱うものとします。
４．本サイト上に本規約と異なる定めがある場合、または本規約に記載されていない定めがある場合は、その定めが優先して適用されます。
５．当社は、本規約について変更等の必要が生じた場合、変更等を行う前の本規約の目的に反しない範囲において、合理的かつ相当な本規約の変更等を行うことがあります。この場合、当社は相当期間前までに、変更等の内容及び変更等された後の本規約の効力発生時期を本サイト上にて周知します。
第４条（本サイトの利用条件）
１．本サイトの利用は無料です。但し、本サイト利用に必要な回線料金等については会員が負担するものとします。
２．会員は、本サイトの利用にあたって、当社の指定する個人情報その他の情報を当社に提供する必要があります。
第５条（本サイトの利用登録とIDの取得）
１．本サイトの利用には登録が必要です。会員は、当社が指定する登録方法より登録の手続きを行うものとします。当社は、登録した会員に対して、本サイト利用の為に必要な会員IDを発行し、会員が登録したメールアドレス宛に通知するものとします。
２．会員は、会員IDと自ら登録したパスワードを使用して本サイトを利用することができます。
３．会員は、会員ID及びパスワードを、善良なる管理者の注意をもって使用及び管理するものとし、これを第三者に開示したり、使用させてはなりません。
第６条（本サイトの提供期間）
本サイトの提供期間は、２０２４年９月１日から２０２６年３月３１日（予定）までとします。期間満了をもって、会員の本サイトの利用は終了します。
第７条（禁止事項）
１．会員は、本サイトの利用に関して、以下の行為をしてはなりません。
(1) 本規約に違反する行為
(2) 虚偽の内容に基づいて利用登録、応募を行う行為
(3) 当社が提供した情報を応募目的以外に使用する行為
(4) 第三者が会員になりすまし、本サイトを利用し応募する行為
(5) 当社や他の会員あるいは第三者の著作権、商標権その他知的財産権、または名誉、プライバシー、財産など法的保護を受ける権利・利益を侵害する行為
(6) 犯罪に結びつく行為、公序良俗に反する行為、その他法に違反する行為、及びこれらの恐れのある行為
(7) コンピュータウィルス等有害なプログラムを本サイトに使用したり、他者に感染させる行為
(8) 本サイトあるいは本サイトを通じて得た情報を自己の営業のために利用する行為
(9) 会員が自らまたは第三者をして、如何なる方法を問わず、本サイトについて、複写、複製、転載、引用、配信（ネットワークに接続されたサーバへのアップロードを含む）、編集、翻案、改変、改竄、翻訳等をする行為
(10) 会員が自らまたは第三者をして、本サイトと同一または類似のものを作成する行為
(11) 会員が自らまたは第三者をして、本サイトに関する出版物等を発行する行為
(12) 本サイトの運営を妨げる行為、またはその恐れのある行為
(13) 前各号に定める行為をするように唆したり、助けたりする行為
(14) その他、当社が不適切であると判断する行為
２．当社は、会員が本規約に違反したと判断した場合、会員への事前の通知なしに直ちに会員の本サイトの利用登録を失効させることができるものとします。利用登録失効によりいかなる損害が会員に生じたとしても、当社は一切の責任を負わないものとします。
３．会員が本規約に違反したことにより当社または第三者に損害を与えた場合、会員は、直接、間接を問わず一切の損害を賠償する義務を負います。
第８条 （会員の登録解除）
会員は、当社が定める手続に従い、いつでも本サイトの登録を解除することができます。
第９条（会員の紛争解決）
会員が本サイトの利用に関して他の会員または第三者との間で紛争が生じた場合には、当該会員が自己の責任と費用負担にて当該紛争の処理、解決を行うものとし、当社に何らの迷惑を及ぼさないものとします。
第１０条（本サイトの提供と限界）
１．当社は、本サイトの完全性、完璧性、無謬性等を保証するものではありません。また、利用登録によって採用を保証するものではありません。
２．下記の事由に起因して会員に損害が生じたとしても、当社は一切責任を負いません。
(1) 会員ID及びパスワードの使用上の過誤または管理不備
(2) 応募情報の誤謬、不備
(3) その他会員の責に帰すべき事由
(4) 通信の不通・不良（原因の如何を問いません）、停電（法定点検による停電も含みます）
(5) 地震、火災、天災地変、その他不可抗力
(6) 通常求められるセキュリティを超えた不法侵入、攻撃、ウイルス感染
(7) その他前各号に準じる事由
３．当社の免責部分を除いた部分で、万一会員が本サイトの利用によって損害を被った場合、その原因が当社の故意または重過失に基づくときに限り、当社はその損害を賠償します。但し、賠償対象となる損害は直接かつ通常損害に限られ、いかなる場合も、特別損害、間接損害、逸失利益、機会損失は賠償の対象となりません。
４．当社は、会員に対する事前の通知を行うことなく本サイトの内容の変更・追加等を行うことができるものとします。この場合、当社は必要に応じ、当該変更・追加等の内容を本サイト上にて告知するものとします。
第１１条 （個人情報の取扱い）
当社は会員が提供した個人情報を適切に管理するものとし、正当な理由なく次項の目的以外に利用しないものとします。個人情報への不当アクセスまたは個人情報の紛失、破壊、改ざん、漏洩などの危険に対抗するために必要かつ適切な安全対策を継続的に講じるよう最大限の注意・努力を払います。
１．会員が提供した個人情報について、以下の者が責任を持って適切に管理するものとします。

２．当社は、会員が提供した個人情報を次の各号を目的として利用いたします。
(1) インターンシップ運営業務（今後のインターンシップ運営の参考のためにアンケート等に用いることを含む）
(2) 採用選考業務（今後の採用活動の参考のためにアンケート等に用いることを含む）
(3) 採用選考の結果採用となった方へ入社前に連絡をするため
(4) 採用選考の結果採用となった方の応募情報については、入社後に当社の人事情報とすること
(5) 今後の当社採用情報(キャリア採用など)のご連絡
(6) 今後の当社採用活動の参考情報
３．当社は、会員が提供した個人情報を第三者提供することはありません。但し、当社は、本サイトの提供にかかる業務を第三者（以下「委託先」といいます）に委託すること、及び当該委託に際して必要な範囲内で応募情報を委託先に開示・預託することがあります。
４．本サイトの個人情報についてのお問合せ・開示・訂正・苦情・ご相談は下記までご連絡お願いします。

５．会員が個人情報を提供することは、会員の任意です。但し、十分な情報の提供がない場合は、本サイトの利用ができない場合や、入社プロセスに進むことができない場合があります。
６．当社は、個人が識別・特定できないように個人情報を統計処理した上で、分析の資料として利用することができるものとします。
７．会員は、自身の会員情報を当社が定める方法により閲覧でき、必要な場合は随時変更することができます。
第１２条（準拠法ならびに管轄裁判所）
本規約の成立、効力、履行及び解釈に関しては、日本法が適用されるものとします。本規約および本サイトの利用に関する一切の訴訟については、東京簡易裁判所あるいは東京地方裁判所を第一審の専属的合意管轄裁判所とします。

本規約は２０２４年９月１日から実施するものとします。

【WEATHERNEWS INC.Recruitment Webpage (Mypage) Membership Terms of Service】
Article 1. Purpose
These terms of service (hereinafter the “Terms”) stipulate the matters, procedures, terms and conditions of access for members to comply with before accessing the webpage (Mypage) (hereinafter the “Site”) provided by the WEATHERNEWS INC. ("Company") concerning employee recruiting and screening.
Article 2. Definitions
Terms used herein shall have the following meanings:
1. "Membership" refers to individuals currently looking for and applying for employment as an employee of the Company from this site, directly or through cooperating sites.
2. “Personal information” shall mean the information pertaining to members, consisting of their names, addresses, phone numbers, email addresses, school names, dates of birth, and other descriptions, which can be used to identify such individuals (including information that may not be useful on its own but readily usable with other information to identify an individual).
Article 3. Compliance with Terms
1. Members shall understand and agree to comply with all details of the Terms upon accessing the Site.
2. At the time of access, members will be considered to have agreed to comply with all the details hereof as the agreement between the relevant member and Company.
3. Any conditions of access to the Site not stipulated herein will be determined each time by the Company; terms and conditions of access and compliance stipulated separately shall be as effective as the Terms and will be treated as such.
4. Any provision on the Site, not consistent herewith or not contained herein, will apply in preference hereto.
5. The Company reserves the right to make reasonable and respectable changes, etc. hereto, to the extent that it does not contravene the purpose of this agreement before the change, etc., when there is a necessity for change, etc. regarding these Terms. In such cases, the Company shall disseminate the details of such changes, etc. as well as the effective date of the amended Terms via the Site before the relevant date.
Article 4. Site Access Conditions
1. Members may access the Site without charge, except for Internet access fees paid by the members.
2. Members shall provide personal and other information as specified by the Company upon accessing the Site.
Article 5. Site Access Registration and ID Acquisition
1. Members shall register to access the Site and shall complete their registration through the procedures specified by the Company. The Company shall issue the necessary membership IDs to the registered members for access to the Site and so notify them at their registered email addresses.
2. Members may access the Site by using their membership IDs and registered passwords.
3. Members shall use and maintain their membership IDs and passwords with the care of a good manager and shall not disclose or allow access to their membership IDs and passwords by any third party.
Article 6. Site Access Service Period
Members will be offered access to the Site for a limited time starting on １ September 2024 and ending on 31 March 2026 (as planned).
Article 7. Prohibitions
1. Members shall be prohibited from the following:
(1) Breach any of the Terms
(2) Register or apply for access based on false information
(3) Use Company-provided information for any purpose other than the application
(4) Allow any third party to use membership identities to access the Site and apply
(5) Violations of copyright, trademark rights, or other intellectual property rights or the honor, privacy, properties, or other legally protected rights and interests of the Company, other members, or any third party
(6) Any act linked to crime, offensive to public order and morals, or any other illegal or potentially illegal act;
(7) Use harmful programs including computer viruses or infect others on the Site
(8) Use for business purposes any information made available on or through the Site
(9) Any act of duplication, reproduction, reprinting, excerption, distribution (including uploading to network servers), editing, adaptation, alteration, or translation of the Site regardless of whether independently or through any third party or how it is done
(10) Produce a website identical or similar to the Site independently or through any third party
(11) Produce any publication based on the Site independently or through any third party
(12) Any act that interferes with or potentially interferes with the operation of the Site
(13) Instigate or aid others to commit any of the acts above
(14) Any other act deemed inappropriate by the Company
2. In the event a member is in breach of any of the Terms, the Company reserves the right to immediately cancel registration for access to the Site without prior notice; the Company shall not be liable for any damage incurred by the member due to cancellation thereof.
3. The member will be liable for any damage directly or indirectly incurred by the Company or any third party due to the breach.
Article 8. Cancellation of Membership Registration
Members may cancel Site registration at any time through the procedures specified by the Company.
Article 9. Dispute Settlement among Members
Each member shall, at the member’s own expense and responsibility, handle and settle any dispute with other members or any third party arising from the use of the Site and not cause any problem with the Company.
Article 10. Site Offer and Limitation
1. The Company does not guarantee the completeness, perfection, or otherwise the infallibility of the Site nor does it guarantee the employment of any member registering for access thereto.
2. The Company shall not be liable for any damages incurred by members due to the following causes:
(1) Misuse or poor management of member ID and/or password.
(2) Misentry and/or defects in recruitment information.
(3) Other reasons attributable to the member.
(4) Interruption or failure in internet communication, regardless of cause. Blackouts, including those related to legal inspections.
(5) Earthquakes, fires, natural disasters or any other irresistible forces.
(6) Hacking, attacks or virus infections which occur past the generally required security.
(7) Other reasons similar to the preceding items.
3. If any damages should be incurred by the member in regards to the use of this website and due to reasons for which the Company's liability is not waived, whether committed intentionally or by gross negligence of the Company, the Company shall be liable for the damage. However, such damages qualified to compensation shall be be limited to direct and normal damage and shall not include any special or indirect damages, lost profits or opportunities in any case.
4. The Company may, without prior notice to members, make changes or additions to information on the Site, in which case the Company shall inform the members of such changes or additions via this website as appropriate.
Article 11. Privacy Policy
The Company shall properly manage the personal information provided by members and shall not use it for any purposes other than what is set forth on the following page without justifiable reason. It shall also make its best efforts and precautions to prepare and continue to implement necessary and appropriate measures against the risk of unwarranted access or loss, damage, falsification or leakage of the personal information.
1. The Company shall ensure that the following department will responsibly implement their respective privacy policies to properly handle personal information provided by members:

2. The Company will use personal information provided by members for the following purposes:
(1) Internship management (including using questionnaires for reference in future internship management)
(2) Recruitment screening (including using questionnaires for reference in future recruitment activities)
(3) In order to contact those who have been selected to hire as a result of the selection process before joining the company.
(4) In order to use as our company's personnel information after joining the company who have been selected to hire as a result of the selection process.
(5) Future notification of our company Hiring Information (Mid-career Hiring, etc.)
(6) Reference information on future our company Hiring Activities
3. The Company will not provide nor will the Company disclose to any third party any personal information provided by members except to the extent necessary for a third-party contractor (hereinafter the “Contractor”) to perform its contract work.

5. Members shall exercise discretion in providing personal information, provided that insufficient personal information may result in failure to access the Site or to proceed in the hiring process.
6. The Company shall render personal information personally unrecognizable and unidentifiable through statistical processing for use in analyses.
7. Members may access or change membership information at any time as appropriate through the procedures specified by the Company.
Article 12. Governing Law and Jurisdictional Court
These Terms shall be established, effectuated, enforced, and construed in accordance with the laws of Japan; any litigation arising from the use hereof or access to the Site shall be settled at the Tokyo District Court and summary court as the exclusive agreement jurisdictional court of first instance.

These Terms shall become effective as of 1 September 2024.
